Terms & Conditions

These conditions apply to the provision of accommodation services, wellness services and the provision of conference and banquet rooms for the implementation of events for all other related deliveries and services. They apply in the same way to the provision of other rooms and areas on the hotel premises. The following terms and conditions apply exclusively. The guest's terms and conditions (uniform designation for the organiser/orderer/guest etc.) do not become part of the contract, even if they have not been expressly contradicted.

1. Contractual relationship The reservation of rooms and areas as well as the agreement of other deliveries and services become binding for both parties with the confirmation of the hotel or, if this is no longer possible due to time constraints, with the provision. The reservation of rooms, showcases and areas establishes a tenancy. Subletting or subletting as well as the use of hotel rooms for purposes other than residential requires the written consent of the hotel. If the reservation is made by a third party, then this third party, regardless of an effective authorization by the guest, also becomes a contractual partner and is liable for all liabilities arising from this contract alongside the guest as joint debtor.

2. Arrival and Departure
Booked rooms are available to the guest from 15:00 p.m. on the day of arrival and until 11:00 a.m. on the day of departure. The room to be allocated to the guest is determined by the hotel on the day of arrival. Unless a later arrival time has been expressly agreed, the hotel has the right to allocate booked rooms to someone else after 18 p.m. without the guest being able to derive any claims for compensation from this. In this respect, the hotel has a right of withdrawal. After that, the hotel can charge 00% of the full accommodation price (list price) for use beyond the contract due to the delayed vacating of the room up to 18:00 p.m. and 50% from 18:00 p.m. This does not justify contractual claims by the customer. He is free to prove that the hotel has no or a significantly lower claim for usage fees.

3. Prices
The prices are determined according to the price list valid at the time the service is provided. Insofar as statutory value-added tax is incurred, it is included in the prices. An increase in VAT after the conclusion of the contract is at the expense of the guest. If a fixed price has been agreed and there are more than four months between the conclusion of the contract and the provision of the service, the hotel reserves the right to make an appropriate price change.

4. terms of payment
All hotel invoices based on this contract are due within 14 days of the invoice date without deduction of payment. In any case, the hotel can demand an advance payment of a reasonable amount from the guest. If the aforementioned payment period is exceeded, the guest is in default without the need for a reminder, in which case the statutory regulations apply. The assertion of a higher damage caused by delay remains unaffected by this. A reminder fee can be demanded in each individual case for reminders that are sent after default has occurred.

5. Withdrawal and Cancellation
In the event of force majeure or other obstacles for which the hotel is not responsible, in particular those beyond the hotel's sphere of influence, the hotel reserves the right to withdraw from the contract without the guest being entitled to any claims for compensation. If the guest does not use the reserved room without informing us in good time, he remains to pay 90% of the agreed overnight stay or package/offer price, regardless of the reason for the hindrance.

Otherwise, the following cancellation conditions apply:

Wellness treatments: less than 24 hours before the appointment – ​​70% of the treatment price

For individual travelers:
up to 2 days before arrival – free of charge
up to 1 day before arrival – 50% of the agreed overnight stay or package price
on the day of arrival – 80% of the agreed overnight stay or package price

In the high season, from June to September, the following cancellation conditions apply to bookings of more than 5 nights at a time:
up to 5 days before arrival – free of charge
up to 2 days before arrival – 50% of the agreed overnight stay or package price
From 1 day before arrival - 80% of the agreed overnight stay or package price

For group travellers: (This includes reservations for more than 12 people with the same accounting.)
up to 60 days before arrival – free of charge
up to 30 days before arrival - free of charge if less than 50% of the group participants cancel, in addition 50% of the agreed total price of the first day of travel including the first night
up to 7 days before arrival - 80% of the agreed total price of the first day of travel including the first night
less than 7 days before arrival - full total price of the first day of travel including the first night and 80% for the following days if the booked service cannot be sold elsewhere.

In all cases, the guest reserves the right to prove that the damage was lower and the hotel that it was higher.

6. Liability
The hotel strives for punctual execution of wake-up calls, the timeliness and correctness of message transmissions and timely delivery of goods of all kinds. Lost property will only be forwarded on request, at the risk and expense of the guest. Otherwise, after a one-month retention period, the items will be handed over to the local lost and found office for a reasonable fee. No liability of the hotel arises from the above mentioned paragraph. If the guest is provided with a parking space, even for a fee, this does not result in a safekeeping contract. The hotel is not obligated to monitor. The hotel is only liable for direct damage to the vehicle that is based on a lack of space that already existed when the parking space was provided, but up to a maximum of EUR 25.000 per vehicle including accessories. The damage must be reported to the hotel at the latest when leaving the hotel property

7. Special Notices for Events
The organizer must procure all official permits that may be necessary for the implementation of the event in good time and at his own expense. He is responsible for complying with these permits and all other public law regulations in connection with the event. Newspaper advertisements and public invitations as well as sales events require the prior written consent of the hotel. The hotel has the right to cancel the event if the hotel's essential interests are adversely affected by the publication or if the hotel has reasonable grounds to believe that the event will endanger the smooth running of business, the security or the reputation of the hotel or the guests threatens. The organizer is then not entitled to compensation.
Insofar as the hotel procures technical or other equipment from third parties for the organiser, it acts in the name and for the account of the organiser. The organizer is liable for the careful treatment and proper return of this facility and indemnifies the hotel from all third-party claims arising from the provision of these facilities. The organizer may only bring food and drinks with him after the prior written consent of the hotel. A service fee will be charged. The hotel reserves the right to change rooms. The organizer must inform the hotel of the guaranteed number of participants in a banquet, conference or other event at least 5 days before the date. Any downward deviations that actually occur can no longer be taken into account within these periods. The guarantee is the basis of the billing. If the number of participants exceeds the guaranteed number by a maximum of 5%, this will be accepted by the hotel in order to ensure that the event runs smoothly. If this is exceeded, billing will be based on the actual number of participants.

Cancellation deadlines are:
up to 30 days before the event
– Free of charge if the hotel is able to rent to another party

up to 14 days before the event
– 25% of lost sales, unless the hotel is able to rent to another party

up to 7 days before the event
– 50% of lost sales, unless the hotel is able to rent to another party

less than 7 days before the event
– 75% of lost sales, unless the hotel is able to rent to another party

Lost Sales means the agreed or cheapest menu/buffet price for events and the agreed conference flat rate/room rental per person for conferences. The requested number of participants is fundamental for the calculation. Special or third-party services already booked by the hotel for the respective event that are not used as a result of the cancellation must be reimbursed in any case.
The organizer is responsible for losses or damage caused by himself, his employees, other assistants and event participants. The organizer is responsible for taking out appropriate insurance. The hotel may request proof of such insurance. In order to prevent damage, the attachment of decorative material or other items is only permitted with the consent of the hotel.
If the rights of third parties (copyrights, etc.) are affected during events, the organizer is obliged to obtain the appropriate permits at his own expense before the event is held and to pay any fees incurred (GEMA fees, etc.) directly. Should claims for damages be asserted against the hotel, the event organizer shall indemnify the hotel against the claimant.

8. General
An ineffective general terms and conditions will be replaced by the parties immediately by an effective one, which comes closest to the ineffective provision in terms of its legal and economic content.
Deviating or ancillary agreements must be in writing. This also applies to the cancellation of this written form requirement. Verbal collateral agreements do not exist. The place of performance is the hotel's headquarters. In commercial transactions, the place of jurisdiction is the hotel's registered office. It is only the law of the Federal Republic of Germany. The application of the UN sales law and the conflict of laws is excluded.
The hotel does not participate in dispute settlement procedures before consumer arbitration boards.
